No response received from Ruggedphones

Good day
I purchased a Titan 1G cell phone from Ruggedphones and it was delivered on the 19th of November. However whilst I was setting up the phone I noticed that the unit have been used before as there was a call and message history on the phone made on the 7th of November from 09H44 until 14H44 on the day. The box was also not wrapped in plastic and the USB transformer and cables were already opened as well.

I email Cindy at Rugged phones to enquiry why I was sold a second hand unit on the 20th of November but Ruggedphones have not responded to my email as all our prior correspondence was done via email. I requested to have a new unit given to me as I paid for a new unit or to be refunded. Since they did not respond I now insist on a refund.
