A new phone has gone in for repairs twice

A new phone (about 3 months) was sent to Cell C for repairs now for a second time, with a time period of 6 weeks (2 X 3 weeks each). After having it back for about 5 hours, the same problem started again. I requested on the second time that they replace the phone, but they insisted that this time it would be as good as new seeing that it undergoes a quality check before releasing it. The phone is fully charged and after about 3 hours, it says "battery use to low for communication" and them just dies. We have bought a new battery after the first repair, just to make sure that it was not the battery, but this also did not solve the problem. We can not go without this phone for another 3 weeks and the inconvenience of getting it back completely erased every time and taking the time to load everything back just to loose it again in now getting ridiculous. My request is one of the following: the phone be replaced within 72 hours, the contract being cancelled or alternatively: I cancel my debit order seeing that my service provider is not providing service.
