8ta sold my phone without informing me

I have a contract with Telkom mobile for a cellphone which unfortunately got damaged, I took it to Telkom mobile Southgate for repairs, when I received the quotation I was told I couldn't accept it without paying 1st which is not what I was told in the store, never the less I couldn't accept the quotation because I didn't have the funds then, the quotation expired then I was told I had to pay R181.50 for handling fees which I did on time, took the receipts to Telkom mobile Southgate and they faxed them to somewhere and I was told to go home and I would be notified when my phone was back which never happened. I went back on Saturday the 12/10/2013 and I was told my phone was sold and they were offline and they will contact me soon which still AGAIN hasn't happened. At this point I am not prepared to accept a phone that was sold to someone and I have no idea in in what condition that "person" kept it in, If I do not get response from someone in the next 48hours I unfortunately will have to contact the Consumer Protection, I have tried so many times to get you guys to resolve it internally but it seems you are all failing.
