Not following terms and conditions as per contract

Phone received on the 26/09/2013, the phone was not functioning. Complaint/query was logged with cell c 30/09/2013, as per contract signed query/complaint needs to be done with 7 days of receiving the phone. On the 30/09 I was told the phone will be collected within 7 working days for assessment and within the next 7 days, the phone will be replaced depending on assessment. I have followed up with Cell C on the 7/10 and the agent did advise the phone will be collected within 2 working days, no collection done. Followed up via email, response i received, that an agent would call within 48 hours, no agent has called. I have followed up with call centre 16/10. The agent says there is no record or has some explanation as to why this Cell C has not kept to their contract conditions. He was not very helpful or informative as he could not explain why the first query was not reflecting on system, said this was due to a bad log. I now need to make a months payment for a phone that I received on the 26/09 that worked for approximately 3 days & I have been waiting for Cell C since the 30/09 to provide some feedback or definite assistance - to no avail, as I have to follow up on progress?
