DATA USED Without my knowledge

I got Samsung Galaxy S3 mini. My data was used although all updates can only occur via Wi-Fi only. My mobile data app was also not active, after reporting it and seeking a detailed solution I was told the data was used and I must take responsibility for it, another consultant told me it was a email send from Gmail, and resented every time.

After checking my mail and the log, no email was send that day or before or even after, from the Gmail account used on the phone.

The sim and IMEI no is mine and I can confirm it, but the data used Why must I pay for something that happen beyond my control, I f I buy a car that start itself and drive now and then the manufacturer must take responsibility, not me kept liable cause I own the product and is still paying the current bill of it.

I need a detailed solution for this problem and either SAMSUNG must recall they galaxy S3 mini, or Vodacom must take responsibility.

I got Wi-Fi and it was on cause my other devices was connected, but the phone that's data was chowed away without my knowledge was offline cause it's service was not needed.

I want a solution or I will go to the OMBUDS MAN & COURT you'll pay legal fees
