Phone on special but no stock available

As per the MTN Cell Network franchise's latests promotion the HTC One X is been advertised on a number of packages. However they cannot process an upgrade as there is no stock.
How can this phone be advertised as part of the current promotions.
I have also phoned a branch and they said stock was previously sent back.
If there is no stock then it should be ordered.
