Will not replace a 12 day old phone

I upgraded to a Blackberry 9360 on 23 July 2013. I took the phone back for a replacement on 5 Aug. 2013. The cellphone's unlock button does not always work, scroller gets stuck and the device does not read the memory card. The consultant took the phone saying it would be sent for a warranty assessment, which was rejected based on a scratch on the phone. The phone was in perfect condition when I took it back to MTN, since I only had the phone for nearly 2 weeks. The consultant who booked the warranty assessment looked at the phone and did not say or remark that the phone is scratched (there was no scratch) and now they have rejected the replacement based on "physical damage" on the device. The consultants did not let me know that the warranty claim was rejected, and I still don't have my phone back, and each time you ask when it will be back they say "today or tomorrow" and now the phone has to be sent away for repairs which will take another 1.5 - 2 weeks. I do not want the phone to be repaired, I want it to be REPLACED, since it is only 12 days old.
