Ridiculous service for cell phone repairs

My Initial phone was taken into Cresta branch around 7 December 2012, for repairs, after numerous phone calls to both the Cresta branch and the repair line to get feedback and constantly receiving conflicting information and constant responses that there is nothing recorded on the system. I finally went into the Cresta branch early February and was told my phone was there. To my surprize it had been replaced without any one notifying me or the branch. About a week after I received the "new" phone, I started experiencing problems with this and made many calls to the customer service lines, the advise seemed to help temporarily. The phone heating up during conversations, and it increasingly changing shape almost bending like a banana, my calls not coming through while I have the phone in my hand and then receiving missed calls. I handed it in May, again no feedback given and now on the 5 June after my calling Cresta I am now told the "new phone is out of warranty" I must pay for it, yet I had not caused any damage to it.. I should be given a new phone cause their "new" actually Refurbished phone is defective. My contract is not cheap, and I pay insurance.
