Not happy with quality of product

I bought a dress ring (it was a birthday gift from my husband) on the 11th August and it went for resizing and i got it about a week or so later. Ive been wearing it since then and it hooks onto everything it ruined a few dresses and scratched my child. the setting part that keeps the topaz stone is sharp and the stone is a bit loose. I have spoken to the store and was advised that because i resized they cant exchange but fix. my argument is why does resizing play a role? so should i walk with big rings to get better guarantees? I had a similar silver ring with the same setting structure that i am wearing for years and it never bothered me. Now this one i am wearing for a few weeks and it irritates me. Why mus this be fixed when its obviously faulty and should not have done this in the first place. this indicates to me i bought a defective product and now NWJ wanna fix it.
i am not happy about this at all!
