And new blackberry not working like brand new

I bought a new blackberry 9380 on contract and since day one the phone has been switching off and on on its own it doesn't even want to read the memory card. I took it back on the 7th day of the 7 day return policy and he did not want to give me a new phone so he send it to vodacom 3 weeks later I got it back today John said the report say its the battery so they gave me a new battery I put the phone on was busy with it at home for bout 15 min and it started doing it again with the new battery. Please help what am I to do now? I can't go without the phone for another 3 weeks, I bought it on the 28th of May had it for 7 days and only got it back today this is not cool I'm going to pay for that phone for 12 months and the 1st month we could not even use it!!!
