ESTATE AGENT REFUNDS DEPOSIT BEFORE SIGN OFF

Absolutely shocking how Fine and Country, in particular the agent, Andries Vermaak, can refund a tenant before the authorisation and hand over of the owner / landlord. The tenants left the property in an absolutely shocking condition, torn carpets (including undercarpet heating) cupboard doors ripped off, sprinkler heads of the irrigation system missing/taken. We were never even informed that they had refunded the tenant's deposit, I had to find this out on my statement. Upon enquiry, I get the reply, it was to help the tenant pay a deposit on another property!!! Now when I have been requesting my payment for the repairs done (Been asking since beginning of September) I get the reply (all via email) they are waiting for the tenants to pay Fine and Country,? ts on the statement which they have sent!! As far as i'm concerned, Fine and Country refunded that deposit, BEFORE authorisation of the owner, so are therefore (Fine & Country) liable to pay for the repairs done. How Fine and Country gets the money back from the tenants is their problem, not ours as the owners as we never authorised for that payment to be refunded.
