CAPE TOWN REFUSE TO PAY POTHOLE CLAIM

I recently drove through a pothole on bosmansdam road just outside montague gardens. My tyre burst and i immediately went to have it replaced. I kept all my invoice and proof of payment and directly after fitting my new tyre i went to take a photo of the pothole that damaged my tyre.

After submitting all this info to Claudene i received a response 2 weeks ago that they will not pay me out as they fixed the pothole the next day. I then said their argument makes NO SENSE as i still drove through a pothole on a busy road.

I then filed a depute against their decision and received feedback to say the city is not responsible as they did not know about the pothole before i drove through it. How can someone in charge f an entire city reason like a 5 year old???

If anyone can assist me on how to take them to court for the physical damaged i received along with the damage to my car i would appreciate this.

I pay more than R6000 in income tax per month and they cant pay me out for a tyre that costs R1500
