Incomplete work expired time line

I have appointment Brand Flooring to be a contractor to complete the building of my home. They have not delivered on our signed contract. They should have taken 1 and a half months to complete the job and three months later the job is still not completed. They have also taken the full invoice value that they quoted me on and they were only supposed to take 70% and yet they don't want to refund my 30% owed to me. After varies complaints to David, Garth and Jonathan, I was now told that I should sue them.
