Swapping new battery with an old one

My wife took my JeepRenegade CRD to have electrical repairs done to the Jeep agency in Bloemfontein some 3 weeks ago. She fetched the car last week. Last night the car failed to start. On inspection it seems the new battery purchaced and installed by Jeep in Cape Town near the end of January 2012, was replaced with an old battery. This was confirmed by an auto electricien on inspecting the vehicle this morning in Maseru, Lesotho (inter alia battery poles were severely worn out). The service manager denies any and all responsibility. As these batteries are very expensive I regard this in a very serious light.
