Not exchanging an incorrect size battery

On March 15th, 2013 I took a battery which stopped working from a toyota corolla 2006 with, to purchase a new battery. The battery I took with was the battery that came with the newly purchased vehicle in 2006. I got an invoice and battery from Midas Goldco in Bloemfotein 051 448 9481. After two weeks the car would not start on somedays but once I jumpstart it or used an alternate battery it would drive without hassle. On the May 2nd 2013, I took the battery back to Midas and they told me the don't give refunds or exchange batteries and referred me to Diesel Electric (DE) to have the battery tested. On May 9th 2013, I collected the battery from DE who told me that the battery is fully charged and should provide reliable service however it is the incorrect size battery for my car. The battery Midas sold me is a 631 instead of a 636. I then went back to Midas and Midas's manager and staff do not want to accept liability for the incorrect battery size battery sold and do not want to exchange the battery. I am stuck with a battery that works intermittently.
