Miway negligence and I competence

Put. In a 3rd party claim and claim declines because their client was adamant its not his fault. Regardless of the facts and evidence provided. Claim never investigated and my husband never contacted to have his side of the story heard. Also their so called assesor was supossed to come out and see the car which he never did. All he did was call to fo find out the make and model of the vehicle and then notified my husband that the car would be wriiten off. How he got to that conclusion he alone will know. How does a insurance company base their results on the word of one person ignoring everything else. Now we are the ones suffering witthout a car. This is my first step before taking them to cout.
