How can you still list me on ITC??

Old debts that have been resolved, Three years have pass and no statement, or any attempt has been made to contact me, I have the same residential address and postal address, I have had many conversations with the bank and both parties agreed that this debt is now prescribed. But after agreeing they sell the debt to a debt collector that is now harassing us and has listed me on ITC, how can a bank do this, THE DEBT IS PRESCRIBED now please sort this out and take me off ITC and Experian or off to lawyers I go. There are laws to abide by not because you are FNB you can do what you want!
