Claim still against my name

My vehicle was parked at a cycling event, guy reversed into it. Took me almost a year and a half to get my excess back from them. Had to phone/email M&F every week to follow up. No one came back to me once. Now, I am going trough the whole process again as the claim is still against my name and my premium has sky rocketed. They are no debiting me every month at the higher premium. It was not my fault so according to my broker the claim should not be against my name as they got their money back from the third party. Now they are conveniently from me every month until they sort it out.
