Outsurance does not want to payThird party claim!!

On the 12/04/2013 i was involved on an accident with one of their client Mrs (Eloise lewis-Enright) where she tried to driving away from the seen where i had to follow her until i manage to stop here by the garage she claims that the were people trying to hijack her and she agreed to pay for the damages. but outsurance refused to pay after taking my car to their assessment center giving the below report.(According to the information at our disposal our client was in an emergency situation and her life was at threat due to an attempt on her life by Hijackers. Whilst the client was busy recovering from the shock of the attempt she collided into your client. Our client can therefore not be held liable for his actions due to the emergency he was placed in. We refer you to the Delictual Liability in Motor Law by WE Cooper published by JUTA & CO, LTD 1996: ) so what i want to know who should be liable for the damages.
