REFUSAL TO CLAIM FROM 3RD PARTY- ACC 3RD'S FAULT

My husband wasbusy reversing into a open parking bay, when the 3rd party came racing past disregarding the fact that my husband was at an angle not to see him, although his reverse lights and indicator was on. The 3rd party should have stopped as he could have seen that my husband was busy reversing into the parking bay but took the gap and in the process slammed into our car, missing the car that was already parked. He stopped and admitted that the accident was his fault and said we can go ahead with the claim. The man he nearly also knocked in said he would be a witness and gave his details. I waited for the 3rd party to tell me when I could submit my claim to his insurer, Outsurance. As he took too long, I therefore decided to claim against my insurer, Santam as they could then reclaim the excess and damage from the 3rd party. After a short while and submissions of all the details, I was informed of the following by Santam: "we will not be pursuing the recovery of your excess and our claims cost as merits is not entirely in our favour. The onus is more on the person reversing into the parking bay and to make sthat no other vehicle is approaching from behind." Really!!!
