Sick and Tiered of SW Upgrades

I've upgraded about 2 months ago, and exactly 10 days after delivery my phone started giving problems, now I know that policy states that you need to return a faulty phone within 7 days, otherwise you need to send it in for repairs. My phone has been in and out of stores for repairs and even been at Vodaworld in Midrand for 3 weeks, and still it's giving me the same problem. Every time I send it in for repairs they do a stupid software upgrade. Now seriously, I can do a SW upgrade, what is it going to take to make you people see it's not the SW but the phone. I'm sorry, I have a new born baby at home and can't go the shop every second day to do a stupid sw up[grade that is not fixing my problem. And even better, when I phoned the call center, the guy on the other side of the line told me he's sorry there is nothing he can do for me, that is just what the phones do. I so regret not listening when he told me his name. He even told me, "you paying insurance, phone then and tell then you phone is and claim a new one." Now what kind of customer service is that?
