Quiry and ncellation of contract not resolved

I was due for an upgrade last year November, I called in to enquire about it and I spoke to Nonhlanhla Vilakazi, I told her which phone I was looking for and she explained to me only the payment options and not the features of the phone.when I received the phone I discovered that I can not do cell phone banking transactions and receive and transfer data from any other devise, I made calls from different numbers I was given when I enquired about the above it's the fourth month now still no difference.soI decided to tell them to take their phone back and cancel the contract with them and pay the penalty fee for using the phone for 4months, they said they wont take the phone back as it does not have a problem its only software problem and that I am the one who called them and choose the phone.according to the new consumer protection act I do have a right to return their phone and cancel their contract if need be pay penalty fee for I have been using the phone for 4months while waiting for them to resolve my problems with their device. And they are declining my cancellation due to their reasons that am the one who choose the device and they assumed I did research before taking it.
