MTN Refusing to Refund Faulty Device

In July 2012 I unwisely opted to upgrade my MTN Cell Phone contract, requesting an HTC One X handset. Shortly after receiving the device, it began to give me trouble and in September I sent the phone in requesting that it be replaced with a new device since it was faulty.

MTN returned the same phone many weeks later having "repaired" it but it soon began exhibiting the same issues only more severly. It failed completely in early December. I was out of the country and could not act on this until my return in January.

In January, I contacted MTN and requested that they refund the phone and cancel my contract.By this point, having been messed around, sent from pillar to post in two separate attempts to get some use out of the device for which I was paying, I was "" of MTN's nonsense and wanted no more to do with them.

The phone was collected by a courier in January and I have not heard from MTN since then.

I have been billed for January and February. This brings the tally to eight months. I am still paying and still have no phone.

MTN: cancel my contract and walk away. This lack of delivery and service is untenable.
