Renewed contract without consent

I have a Top up 49 contract for my domestic worker. It was up for renewal in January 2012; I received a call from someone claiming to be from Vodacom to offer me various phones which I could choose on contract renewal. I chose a basic Nokia phone, and agreed to renew.

4 weeks later I had still not received the phone so I called the call centre, they told me that it was not in fact Vodacom service provider who had contacted me, but the cellphone store in Brightwater Commons where I originally took out the contract. I phoned the store and they acknowledged that they never provided the phone, and agreed to cancel the contract renewal to give me a chance to shop around.

I asked them to phone me back when the contract renewal was cancelled and they did.

Since then I have not really had a chance to look at contracts again, but I found out this week that the contract had never been cancelled so if I want a new phone for my domestic I have to wait another year. This is unacceptable since I was told the contract was not renewed, and since I did not receive a new phone on renewal.

I am not looking for a refund but I want the contract cancelled.
