Iphone uncontrolled bandwidth use

I have an iPhone 4s that was eventually replace by voda store due to uncontrolled bandwidth use. I've attempted on several occasions at repair store to get it looked at - not to mention their poor service in getting back to me at the time to bring the phone in. Nonetheless I also complained to call centre that my phone was using bandwidth and that I had impossible data bills for that few months. Note I have an iPad with me all time, so I don't use my phone for unnecessary browsing. I eventually got a report from data centre and was told that my phone was updating early hrs between 3 and 5 am. The time I'm asleep of course. All updates on phone was switched off. the data centre assistance mentioned it could be a software fault. Which is why I wanted a new phone.

Anyway phone was replaced after much complaints. Now I wanna know am I responsible for that data bills paid in or can I claim for it? Surely it was not my fault the software caused this???
One of the data bills alone was around 2k then another over 1k and so on.

How do I move fwd from that unnecessary loss?
