Manufacturing flaw results in damage

I recently got a Nokia Lumnia 520. Its a really nice phone and functions well on the whole. The problem is that to use the camera you have to press the capture button really hard. Furthermore the button you use to capture a picture is on the side to the phone which is not square but curved. As a result I was taking a picture and due to the curve and the force that you have to use to take the picture it jumped out of my grip when taking the picture. It fell on the floor cracking the screen and thus the touch sensor aswell.

I approached Vodacom repairs shop in greenpoint who advised me I was negligent and that Nokia would never repair the damage free of charge that I would have to pay for the damage and that it was my fault. I do not feel that this is fair. Why is it that when the design of the phone resulted in damage due to it slipping out of my hand and I am liable for this. I can show this easily by demonstrating it as everytime I take a picture the handset slips out of my hands!
