Faulty Handset with contract

I received a Samsung S4 mini from my wife as a gift and the contract was taken out with Telkom Mobile in Port Elizabeth on 07/10/2013. I wasn't aware that the video playback was faulty as I haven't used that specific feature as yet and found that out at a later stage. I then sent the handset in for repairs at the shop on the 27/10/2013 and got it back on the 08/11/2013 on to find that the video player was repaired but the Wi-Fi was now not working. I took it back immediately and made a booking for the repair. Initially it was a software problem but later turned into a hardware replacement. I went back to the store a week later (15/11/2013) only to find that the handset was not booked in for repairs yet and was only done 4 days after I queried the status on the repair. It is now 4 weeks later and I still have no phone as it is awaiting parts for repairs. Firstly, how can a NEW phone be that inoperative that it needs new parts within 3 weeks of actual usage? Why not just replace the faulty unit and send the defective one back to the supplier? Surely there is an agreement between the supplier and the network provider in terms of defective handsets. Please provide me with a solution...
