Vodacom Scamming or conning me?

Surely ICASA should have a regulation on MCO's that bill clients that don't have a contract with them. Vodacom had better prepare for another lawsuit. I ordered a white Samsung Galaxy S4 Zoom online from Vodacom, 2 weeks passed and i hadn't heard from them, i called in and my order was captured. I had been promised delivery in less than 5 days but when a week passed I called in and was told that they do not have the color that i want, i told the consultant that I will wait until they have that specific color in stock. On the 23rd August i receive a handset delivery of the wrong colour to my disappointment I immediately called Vodacom to cancel the contract, I was promised that the courier will come and fetch the instrument, some time passed I offered to drive to Voda World to return the unwanted instrument but was again assured that they will pickup and cancel the "contract".
As i lodge this complain via Hello Peter, I still have an unopened, unwanted cellphone with me, regardless of the numerous calls to 0821945 to come fetch this device. I am officially informing Vodacom that I am opening a case of against them because they have been billing me since August till this day.
