Staff do not know CPA regulations

My 2 month old b/berry 9320 trackpad went faulty. I went to Cell C Ballito. The Consultant saw the fault and indicated that the phone would still need to go to the repair centre to be verified. I indicated that I do not want it repaired, I want a replacement phone. I stated this very clearly on the Form PRE676778
After a month I had to contact Cell C to establish the status, which is when I was informed that the phone had been repaired and I need to collect the phone. I informed the consultant that I am not prepared to accept the repaired phone.
Later in the day I received a call from another consultant, who informed me that the phone is ready for collection, when I informed him that I am not prepared to accept the repaired phone, he indicated that a new phone is ready for collection
I went to the store only to establish that it is the repaired phone. In terms of my rights, I informed the consultant that I am not accepting the repaired phone and went as far as completing the cancellation form to indicate that I am not prepared to accept a repaired phone
Speaking to the Ops Mgr Sivi Pather was another waste of time, I am still awaiting feedback.
