Charged for BIS when I own an iphone

I have recently noticed that I am being charged for BIS. I upgraded my contract from a blackberry to an iphone. When I contacted vodacom the lady informed me that it is my duty to inform vodacom (if I upgraded with vodacom surely the decent thing to do is to inform me that I am being charged for BIS). So I informed the lady, now that Vodacom is aware that the charge should have not be deducted, I should be refunded all monies. She tells me they won't because I should have informed vodacom. but what she can do is cancel it... really!!! that's obvious. Surely, Vodacom has some integrity and honesty in them to do the right thing??? My call has been 'referred', this is now the 4th day and no favourable response yet...
