Lacklisting and account handed over for legal

In 2009 - 2010 i was called by an agent to take out a 2 cellphone deal wuth cell c which i did.i received ny phone but the following day i took it in for assesment and repairs at cellc in Tygervally centre, cape town because the speaker wasnt working.i was told to relax and they will fix it and call me to collect my phone.after a week i went back to follow up but my phone wasnt there yet.i went back 2 weeks later and the same story.a month later i went back and was again informed that i'll get my phone soon.its now 2013 and i'm still waiting.i was called by their debt collecting department because i stopped to pay the contract and i explained the reason to them.they stopped calling me however.a week ago i received a sms that my account was handed over and i must pay the sum of R5500.the other phone got stollen a month after i took the contract and i've faxed my contract details & sworn affidavid to cell c but no one assisted me.i have time and again faxed the invoice from the repair centre & affidavid but no one helped me.why must i pay? I am taking this to the ombudsman if my name is not cleared.and why after almost 2 years do you hand me over? i am now taking legal action
