Conversion from Top-up to Smartlight Contract

When I upgraded I specifically looked for a phone on the Vodacom4me website that was available on the same or very similar top-up contract I was on as affordability is an issue for me. I then made my decision of phone from the list that was returned to me of phones available for upgrade with the specific search criteria of top-up contract.

I was already on debt review at time of upgrade and along with debt review, the consumer protection act clearly states that no contract may be upgraded when affordability is a problem.

How was it possible for Vodacom to change my contract from a top-up (capped) contract to a full contract with a phone well known for very high data consumption even when not actively using it? With affordability being an issue, how can a contract with an average monthly bill 5 times higher than my average monthly bill of my last phone be granted to me causing serious debt problems when I was trying to control costs, hence the choice of Top-up contract only, as it is capped!

When I accepted and requested a phone for upgrade, I believed it to be in the same top-up contract bracket as my previous one. This is clearly not the case!
