Provider don't want to replace damaged phone

On the 18thof January 2013, i took out a blackberry 9320 on a R159 top up Vodacom. AfterI signed the contract the sales lady just handed me the phone, without opening the box. When we opened the phone at home, the back cover did not want to close properly, there was still a gap. After a few hours the same day i took it to the sales lady to complain about the faulty back cover. She said it was a out of box failure. I asked her for a new phone to replace the broken one, after that she referred me to the owner Kobus. He informed me that the technician will take a look at it, the next morning. On the 19th of January, I returned the phone to him where he promised he will inform me what the technician have to say. After no responce from him, I went back to him. When i confronted him to replace the phone with a new one, he had a bad attitude. He had many different stories about the technician and the phone. At first he said the technician looked at the phone and afterwards he said he could not get hold of the technician. I left the phone there at the shop and wanted to cancel the contract, he refused to do so. What am I suppose to do now, and I want the contract cancelled. It is poor service from Vodacom.
