I applied and signed for a new contract with Cell C on 1 MAY 2013 which included the porting of my number from Vodacom to Cell C. With the contract I was to receive a Samsung S3 Mini smartphone which I desperatley required for my business so that I may receive emails on the move. I did receive the device however that same day I returned it due to a faulty speaker problem. This is where my the problem starts.

First off I was infuriated at the lack of compliance which the staff member at bayside branch showed when i attempted to return the phone. Her initial advice to me was to keep the faulty phone and hope that it will fix itself? After reminding her that if the phone continues to give problems after the 7 day warranty period then I would be stuck with it she accepted the apparently dreaded task of filing an OBF book-in Form and informing me that a new handset would be available within 2 weeks. I required the handset then and there. I should've received a replacement on the spot considering it was clearly faulty. It is now the end of the month... 28 days later and still no phone. I should claim for damages considering you are clearly not holding up your end of the contract
