Acc opened without proper contract & docs

Mtn has opened accounts with both my name and my husbands and has now handed us over without informing us once or sending us a statement. When asked about a copy of the contract we were told that they dont have one but has the odassity to hand us over to attorneys who also does not this copy. We have submitted affidavits and ID's over several times but this account is still not written off.
