New Contract - 7 Day Period

According to my knowledge you have 7 days to take your phone back if you upgrade, if there is anything wrong with the phone and they must give you a new phone. We got a new Z10 on Saturday 27 April 2013 and the phone keeps on rebooting itself. What is the procedure because they absolutely refuse to give us a new phone. We took it back today, and it has only been 5 days since purchase. VERY ANNOYING!!!
