Bed not deliver no refund

Hi, in December 2012 I bought a bed from Leon, when ask how much it will cost to deliver to Cape Town he said that he is coming to Cape Town before the 20 January 2013 and if I pay the deposit of R3500 he will no charge me anything bringing it to Cape Town which I then do. On the weekend of the 18th January he informed me that his truck are leave JHB and will be in Cape Town the following day. The next day his truck broke down outside Bloemfontein and that was it.
I completed the necessary forms to be refunded but up till now just empty promises. If you try to call him, he never answers his phone and is always out of town. Unfortunate I have to lay a case of against his company for not refunding my money. It's really sad that people are dishonest. Will never buy from him or recommend anyone buying from him!!
