OUT OF BOX FAILURE- NO RIGHTS AS PER CPA ACT

My wire purchased a blackberry 9320 cellphone on the 19th October 2013 at 10:50am. I checked the phone out and found it to be defective faulty keypad. I called the branch this morning at 10am to report the fault. I asked the sales person to find the nearest branch that I could go and take the unit into for a replacement. I was informed that I cannot exchange the phone as per Foshini's policies and procedures. I asked her then i want a full refund and was informed that they do not offer refunds on cellphones. I informed her that this is in violation of the CPA Act. She informed me that this is their policy and they dont offer refunds, they only offer replacements or repairs. I informed her that this is incorrect as the cellphone is an out of box failure as the keypad is faulty and its within 24hrs of purchase. I informed her that I am aware of the CPA ACT as i work for a retail shop who sells Vadacom handsets. I was informed to take the defective cellphone to a local markhams to book the pnone in for assesment which will take up to 7 working days to and another 4 days to replace the Out of box failure. I have handed over the device to markhams. Major CPA Violation???
