Can you be out of stock on the day the sale starts

I went into the Eastgate store on the day the sale started to enquire about a few rings I liked. Nini told me they do not have the ring in store but will order it for me. Almost 3 weeks later I'm told sorry they need to make the ring which will take 2 months, and there is no gaurantee it will still be on special. Is that not false advertising.
It is advertised in the diamond catalogue at 50% off, but most of the rings are out of stock. How convenient.

Totally disappointed. if they advertise something, they have to make it at the same price if they do not have stock. Can they not be sued for false advertising
