EAAB unable to manage estate agents that lease

In October 2013 I lodged a complaint against Independent Estates of Africa CC in that they knowingly leased a property that was infested with wood borers without advising me of such. I only discovered this after I had moved in and despite numerous attempts nothing was done until I lodged a complaint with the Rental Housing tribunal.
A bit of history the unit was leased to me via the agent and I had no contact with the owner. According to Thuli I could not lay a complaint against the agent as the owner is responsible and the EEAB does not cover lease agreements. If the agent wilfully mislead me I strongly believe that the EAAB should have disciplined the estate agent for this matter.
Having reviewed consumer law my only recourse is via the EAAB, but what more can a consumer do if the EAAB is not willing to take action.
It must be noted that the agent refused to appear before the tribunal and that judgement was made against them in their absence. The fact that they refused to appear before a legislated forum clearly indicates the character of the agents that the EAAB protect. Just because EAAB collects fees from agents doesnt mean they shouldnt discipline them when required
