Letting other people stay in place while we are paying rent

We saw an add on gumtree about a beachfront apartment that we where really interested in. The place were taken by someone else, but she told us about another apartment in the same building. She mailed photo's of the place. When we wanted to move in, the place was a big mess. Not painted, cleaned, ect as promised. Also there were cockroaches and a broken window. We immediatly called her letting her know that we are not interested anymore (not what she promised) and sended an e-mail the next monday. She said it is fine but did not pay the months rent back for the owner lost the months rent. We drove by a few days later when I saw curtains hanging there. I ranged the bell and a guy told me that they moved in a while ago. Meaning she kept our rent while there is someone staying in the place! This place is our rental apartment for the month as we are paying for it. The worst agency we have ever worked with!!! Lying to us telling us nobody is living there while I just spoke to the guy living there!!!
