Dud sold as brand new

I have purchase a scooter two weeks back:

The automatic starter is not in a working condition and has only worked once in the two weeks that we have the scooter other than that we had to kick start this.

The top speed on the scooter is 20km an hour as soon as you accelerate and go faster you hear a sound like air releasing and the bike cuts of and need to be kick start again.

Till such time the above is fixed they refuse to provide me with insurance, seeing it poses a big risk.
