Claimed 360km per tank vs Actual 277km per tank

I bought a brand new Enzo 150cc from motormia fourways based on their website advert that the bike can get 360km off of a single tank of petrol.
I was fully aware that theeir was no fuel gauge on the bike on purchase. The logical way to monitor the fuel would be to base it on the kilometer on the odometer, right?
Either that, or shake the bike and listen for the fuel (which isnt the most reliable approach)
So I went with monitoring the odometer.
I left my house, having looked at my odometer reading of about 272km, and decide that I have plenty of fuel to drive the 10km there and 10km back to and from gym.
Halfway there, my bike cuts out (a problem which I had addressed motomia with before, which I think they fixed on their first service of the bike) on the 277km mark.
I then pushed the bike 5km back home and notified motomia that I want the bike replaced due to the bike cutting out again. Turns out the the fuel tank was completely empty (even on reserve). I then complain to them that it's misleading that there is a 80km difference!
Now i must collect the bike to avoid a storage fee, as well as now pay for the callout fee (which was free before the complaint)
