No Refund on 2 month notice cancellation

I sourced a place that would allow me to have my sons 1 year party where I could serve lunch to the family and entertain the kids as well as I have people making a special trip for this event. I telepathically confirmed the request was possible with Penny and on the 20-04 when I went to view an employee confirmed my request was possible and my husband present (stipulating that i want a sit down lunch confirming the use of the chairs and tables). After paying my deposit a week later and now confirming my requirements this week, I am told its not possible and this was never agreed to. I tried to get Penny to make adjustments as this is what I paid for and it was refused. The booked date for the party is 29-06-2013 and I now cancelled on the ground that the services I was promised can not be rendered. This is enough notice and its only fair that my deposit gets refunded, which was refused.
