Samsung sells factory defect phones!

I was sold a Samsung S3 phone on a vodacom contract and I recently found out after weeks and months of asking, sending my phone in and driving up and down to my vodacom shop to try figure out what the is wrong with my phone. A Samsung representative on site sent my phone in to Samsung and had their technicians look at it. The diagnosis was that the phone had a factory default and now I the CONSUMER am expected to PAY an ACCESS FEE on top of being sold a faulty phone to begin with. I have not had my phone for weeks now and have no idea where it is now or if either one Samsung or vodacom are taking responsibility or the courtesy to FIX my phone when it should actually be replaced!!! I have no replacement phone and neither company has bothered to call me to apologies or let me know what is going on. I am expected to be going to the store on a weekly basis which is shocking service! Samsung is the worst brand I have ever encountered and the agents about how "good" the brand is. When I try calling the Samsung rep their phones are always on voicemail! I am going to follow this incident up with consumer protection because I refuse to pay a monthly contract for something damaged!
