Deposit paid in Jan to GrandD still no work done

We paid Gary Dippnall a deposit of over R25000 in January 2013 to install a composite wood deck for us. He still hasn't done any work or even delivered the wood and its June now. When I call him he doesn't answer, I received a sms from him every now and then promising he will start next week and so it carries on. I haven't heard anything from him since 4th of June. My lawyer did call him a week ago and Gary promised him that he will contact me on that day. Still no word...
