Waterproofing issues - Latent defect

In 2008 we purchased a grown floor unit in The Stableyard, Royal Ascot for the original owner, through Shades Apart (Karen & Tony Maneveld). It was noted, by Karen, that the unit was in a good state and there was no underlying issues. Within the first year of our living there, it was quite apparent that there was a waterproofing issue to the unit, originating from the above balconies. On further investigation, it came to light that the original owner had noted the problem to the developer and sales agent, but was never disclosed to us on the offer to purchase.

We approached the developer, Coetzee (MD @ Gr8 Investments), to note the waterproofing latent defects and to find out his approach to have it repaired. After two years of communication and fighting to have the issue resolved, they agreed to see to the damage and do repairs. Unfortunately the repairs were not successful and the water damage has subsequently worsened. The water is seeping through the wall and the plaster is falling off the walls.

They are now refusing to tend to the issue and are looking to sell their unit in the block, where the water is originating from. Leaving us to tend to the issue alone.
