Breach of Contract

Cars & Transport

Hello Peter

I bought car on Sat 16-02-13 and i was assured that the car is in good condition. However before i drove it i took to Dekra AA for roadworthy and muti-point check and it failed the test. I contacted the agency and informed them of this and i was suppose to return it today 21-02-13 for fixing and it broke down. The company i work for has a legal representative for their employees so according to the Consumer Protection Act Section 56 i am aware that i have the right to :

1. Return the car and the supplier repair it at their own cost
2. Return the car and the supplier replace it with a similar model
3. Cancel the agreement with the supplier.

These guys are hard to get, for me to get a single response i have to wait for hrs for it. I was suppose to meet up with the manager so he can give me change of ownership docs and i hand over the car for repair. He tells me i need to pay the outstanding amount first, over the phone How can i with a broken car?? I drafted an agreement that he needs to repair the car, and i take it for 2nd testing, if they cant and it fails the test then they replace it. I needed to speak to him, he is still not available. I send the agreement via email
