Rental Company refuses to PAY excess

I was in a accident last year 5 August 2013 that was caused by a foreign gentleman by the name Xavier Guillot.

At that point I got all his information which included licence plate number etc. In addition, King Price Insurance has been struggling since September 2013 to recover my excess from Thrift Car rental (The CAR rental company that Mr Guillot used)

Thrift Car and Van Rental has subsequently repudiated the claim saying that their client did not take out 3rd party cover. This means that I have to contact a man that might not be reachable for an accident that was not my fault.

In terms of the law, I believe that it is actually unreasonable that Thrift is not taking responsible for an accident that was caused by their car, irrespective of who was driving it. e.g. If someone else was to drive my car and make an accident I would still be liable.

Now it has been 5 months and I am losing interest on this money (even if it is little) and I would like my excess back.

Otherwise, I will seek legal advise and sue them for discomfort and Interest lost on the excess.
