Brakes fail after inspection

The vehicle was taken into Kia Sandton for a full inspection but highlighted a number of issues I wanted specifically checked, this included a noise from the left back wheel. the car was returned with an all clear and the noise on the back wheel related to "highspots" on the tyre.

whilst driving the vehicle on the highway (my wife and 3yr old child) the breaks failed.

I need to know why this issue was not identified during the inspection? why are the bolts on the caliper of the incorrect size and what will Kia do to remedy the situation now?
